Mother & child at Surrogate Families

Surrogacy legals

The Surrogacy process is a ‘grey’ area, with no legal structure in many countries, so each case is individual.

The surrogacy providers we work with have processed many surrogacy cases, going back as far as 2007. They can refer you to inexpensive and reliable legal services to help you bring your child safely home.

Our program partners will include legal costs in their fees or refer you to experienced surrogacy lawyers who have helped many people before you.

Different countries have different laws regulating gay surrogacy. Some countries, such as the Ukraine, don’t have a surrogacy process for same-sex couples or single parents.

This can restrict the options for a legal surrogacy process for Gay parents. In some countries, all couples and singles need to go through an additional procedure to be legally recognized as the parents of their children and to obtain a birth certificate. This might include:

  • A pre-birth order to secure their surrogacy journey.
  • The full adoption of the surrogacy baby as part of the surrogacy process
  • Parent adoption, or second-parent adoption to ensure both partners are legal parents of the child.

The intended parents need to consult and work closely with surrogacy professionals and a lawyer familiar with relevant surrogacy laws to navigate the legal procedure. You can start by speaking with one of our professional consultants to discuss the requirements for your situation and find out your choices for accessing the relevant surrogacy procedure, no matter where you live.
